{"id":348,"date":"2017-08-05T23:37:29","date_gmt":"2017-08-06T04:37:29","guid":{"rendered":"http:\/\/richardvleeattorney.com\/?p=348"},"modified":"2024-10-29T22:35:09","modified_gmt":"2024-10-30T03:35:09","slug":"what-is-chapter-7-bankruptcy","status":"publish","type":"post","link":"http:\/\/richardvleeattorney.com\/?p=348","title":{"rendered":"What is Chapter 7 Bankruptcy?"},"content":{"rendered":"<h2><strong><span class=\"_Tgc\">A Chapter 7 Bankruptcy is a liquidation.\u00a0 In this type of proceeding the debtor&#8217;s non-exempt assets, if there are any, are sold by the Chapter 7 Trustee and the proceeds from that sale are paid out to the creditors according to the priorities established in the Bankruptcy Code.\u00a0 A Chapter 7 does not involve the filing of a Plan, nor the repaying of the creditors on a monthly basis.\u00a0 There is an income means test to see if you qualify for Chapter 7.<br \/>\n<\/span><\/strong><\/h2>\n<h2><strong>The primary reason for filing is to discharge certain unsecured debts, (such as medical and credit card debts) allowing the debtor a &#8220;fresh start.&#8221;\u00a0 After discharge the debtor has no liability for those discharged debts.\u00a0 The right to a discharge is not absolute, and certain types of debts are not discharged, such as taxes and student loans.
